Possible wave of consumer lawsuits against fuel cell distributors in sight

  • Captain Frank provides quick and uncomplicated assistance with claims against energy system distributors

  • Precedent: Fuel cell manufacturer must refund advance payments due to incorrect cancellation policy
  • Captain Frank offers a fully automated process from claims handling to filing a lawsuit to payment and booking
  • Fee only in the event of success

Munich, 18.11.23 - Captain Frank is revolutionizing the market for consumer claims with its unique software. A current example is a claim for reimbursement of a down payment for a fuel cell heating system that was not delivered. Unlike the competition, Captain Frank, with its robust tech stack, is able to flexibly introduce new offers and process any type of claim, as is now the case with claims against a distributor of energy systems for private homes.

"Many customers of energy system distributors, e.g. from B4H Brennstoffzelle4 Home GmbH, will rightly claim back their deposit due to non-delivery," says Michael G. Hoesch, founder of Captain Frank. "Our platform is able to process these claims in the shortest possible time, from filing the claim to payment and posting. In the event of a lawsuit, the lawyer only has to send the file we have created, including the prepared statement of claim, to the court via the beA mailbox."

High flexibility thanks to state-of-the-art technology

"With our fully automated, 100% proprietary technology, we are able to process a wide range of consumer claims, such as flight delays, gym cancellations or down payments for heating systems, and respond quickly to regulatory changes," explains Constantin von Mutius, CTO and co-founder of Captain Frank. "New products can be implemented in a short space of time. In addition, the volume to be processed can be increased considerably without increasing operating costs. It is therefore only possible to charge a fee for our services if they are successful."

New level of claims processing

Captain Frank's fully automated solution for processing claims and receivables enables customers to receive their claim at the click of a mouse. Using an easy-to-use navigation interface, the customer enters the required data and, after checking it, immediately receives a declaration of assignment and a claims contract. Captain Frank then initiates the process on behalf of the customer and informs the debtor of the receivables agreement. If the debtor accepts the claim, the customer receives the money minus the processing fee. "If the case has to be settled in court, the automatically prepared statement of claim can be submitted via one of our contract lawyers," says Hoesch.

„Proof of Concept“

In the case of flight delays and the reimbursement of fitness club fees, Captain Frank has already proven that the technology developed in-house works smoothly. A brand new addition is the refund of down payments for alternative energy systems. Here too, the customer only has to pay a fee if the refund is successful. "We are also particularly proud of our self-developed booking system. Whether Captain Frank has one booking or one hundred thousand booking transactions per month no longer matters in terms of price. Our tax consultant only charges a small fee for bookkeeping. This is a game changer that can certainly be used in many similar cases," says Hoesch.
