Does the airline have to pay compensation if the travel agency has made an incorrect booking?

Booking flights can be a complex matter, and mistakes are unfortunately not impossible. One particularly annoying case is when a flight is canceled due to an incorrect booking. In such situations, the question arises not only of a solution to the unexpected problem, but also of financial compensation.

What mistake did the travel agency make when booking the flight?

In the case of a group trip of 9 people from Hamburg to Krakow and back, the passengers were not allowed to fly because their travel agency had booked the wrong flights. The provider booked the return flight for June 14, but the customer received a booking confirmation for June 16.


Is compensation for denied boarding legal?

When the group wanted to fly back from Krakow to Hamburg, the airline refused to take them on board because, in its opinion, there was no booking. The plaintiff demanded compensation for this denied boarding and was proved right.

The Hamburg District Court recently ruled that passengers whose flight was incorrectly booked by a travel agency are entitled to compensation from the airline if the airline refuses to take them on board.

How did the airline react?

The airline tried to defend itself and argued that there was no booking for the flight in question. However, the court considers a booking confirmation from a travel provider or flight agent to be binding and ruled that a claim for compensation exists. It is up to the airline to take recourse against the travel agency if necessary.
